Mental Illness and Exoneration in the Law

Claire Hogg and Lord Mance discuss the relevance of mental disorder to culpability assessments within the criminal law. In this talk, Claire Hogg discusses the relevance of mental disorder to culpability assessments within the criminal law. Her most recent work proposes a guiding heuristic for the reformulation of objective tests, to significantly expand the options available to us in assessing the culpability of defendants with mental disorder. Dr Claire Hogg is a researcher in criminal law and legal theory, with additional interests in medical law (most specifically mental health and capacity law), and moral philosophy. She is particularly interested in questions that arise at the intersections of these fields, and her current research is concentrated on mental disorder as a factor relevant to culpability determinations within the criminal law. This talk will be chaired by Lord (Jonathan) Mance, former Deputy President of the Supreme Court. He currently sits as an international judge on the Singapore International Commercial Court and as an arbitrator.
