20% Affordable, Give or Take: A Spotlight on Inclusionary Zoning

Dive into the real deal on inclusionary zoning and see what 20% affordable really means in today’s housing scene! MIT Center for Real Estate will host a symposium on inclusionary zoning at the MIT Media Lab. The program brings together practitioners and scholars to examine key financial, legal, economic, and policy issues related to inclusionary zoning and housing development in Greater Boston and beyond. Recent developments have brought the economics and constitutionality of inclusionary zoning requirements into sharp focus: the lawsuit brought by Columbia Street LLC and the Pioneer New England Legal Foundation against the City of Cambridge; the U.S. Supreme Court's decision in Sheetz v. El Dorado County (2024); the more recent U.S. District Court decision in Palmer Kearney Mesa Properties, LP et al v. City of San Diego (2026); and the recent dramatic slowdown in multifamily housing construction in Boston. Taken together, these point to the need for a serious, informed conversation about housing development and affordable housing mandates. The afternoon will open with a working session grounded in the financial profile of a hypothetical project subject to an inclusionary zoning bylaw, followed by three moderated panels addressing, in turn, the key legal, economic, and policy issues. A reception will close out a great afternoon of education and discussion.
