Please read the waiver carefully and complete the registration in its entirety. By completing and submitting this registration, I certify that I am the parent or legal guardian of the participating child and that I have read, understand, and agree to the terms of this waiver. I understand that submission of this registration constitutes my electronic signature and indicates my consent to and acceptance of this waiver on behalf of myself and the participating child. 1. PARTICIPATION AUTHORIZATION I am the parent/legal guardian of each minor participant named above, or have lawful authority to sign on their behalf, and authorize each participant to attend and take part in the Event. I understand the Event is hosted and organized by Bzzzy Boys Book Club, a nonprofit organization, using facility space made available by Action Creative Village LLC and PEW LLC. Participation is voluntary and I may remove any participant at any time. I understand the Event includes age-appropriate book-club activities (reading, discussion, games, arts and crafts, refreshments, indoor movement) AND physical/active play for toddlers ages 2-5, including without limitation running, climbing, jumping, use of soft-play or inflatable equipment, ball pits, tumbling mats, playground-type equipment, obstacle courses, dancing, and group movement games, whether provided by Bzzzy Boys Book Club, Action Creative Village LLC, PEW LLC, or any third-party vendor engaged for the Event. I understand toddlers ages 2-5 have limited coordination, judgment, and impulse control, and that physical activities carry risks specific to this age group. This Agreement applies individually and equally to each minor participant listed above. 2. ASSUMPTION OF RISK I understand participation and presence at the Premises involve inherent risks that cannot be entirely eliminated even with reasonable care, including but not limited to: slips, trips, falls, collisions, cuts, bruises, strains, sprains, and fractures; injuries from climbing, jumping, tumbling, or use of soft-play/inflatable/playground equipment; contact with other children, staff, furniture, or fixtures; allergic reactions, choking, and medical emergencies; exposure to communicable illness (including colds, flu, COVID-19, and viral/bacterial illness); acts or omissions of other participants, parents, or third parties; equipment malfunction despite reasonable inspection; and loss, theft, or damage to property. I knowingly and voluntarily assume all such risks, known or unknown, foreseeable or unforeseeable, for myself and each participant listed above. 3. RELEASE OF LIABILITY AND COVENANT NOT TO SUE For and in consideration of each participant being permitted to attend the Event, and to the fullest extent permitted by Georgia law, I, on behalf of myself, each participant listed above, and our heirs, representatives, and assigns, release, waive, discharge, and covenant not to sue the following (collectively and equally, the "Released Parties"): (1) Bzzzy Boys Book Club, a nonprofit organization and the host and organizer of the Event, including its founders Kailen Drayer, Shakila Muhammad-Che, and Naja Ross, and its officers, directors, board members, employees, volunteers, and agents; (2) Action Creative Village LLC, in its capacity as the facility made available for the Event, and its owners, members, managers, officers, employees, contractors, agents, and insurers; (3) PEW LLC, in its capacity as the facility made available for the Event, and its owners, members, managers, officers, employees, contractors, agents, and insurers; (4) any third-party vendor or equipment provider engaged for the Event by any of the foregoing; and (5) the owners, operators, and occupants of the Premises. Each of the parties named in items (1) through (5) is released to the same full extent as every other, without priority or distinction among them. This release covers all claims arising from any participant's attendance, participation, or presence at the Event or Premises, including the physical-activity components, including claims for bodily injury, illness, disability, death, emotional distress, or property loss. THIS RELEASE INCLUDES CLAIMS ALLEGING ORDINARY NEGLIGENCE BY ANY RELEASED PARTY, INCLUDING AS TO SUPERVISION, PREMISES, EQUIPMENT, ACTIVITIES, OR STAFFING, WHETHER THE ALLEGED NEGLIGENCE IS THAT OF BZZZY BOYS BOOK CLUB, ACTION CREATIVE VILLAGE LLC, OR PEW LLC. Nothing in this Agreement releases any claim that cannot lawfully be released under Georgia law, including claims for gross negligence, willful or wanton misconduct, or intentional misconduct. I understand none of the Released Parties are insurers of any participant's safety. I understand that Bzzzy Boys Book Club is the host and organizer of the Event, solely responsible for planning, staffing, activities, equipment, and supervision, and that Action Creative Village LLC and PEW LLC have made the Premises available for the Event only; both roles are released equally under this Agreement. 4. PARENT/GUARDIAN CLAIMS; MINORS' RIGHTS I understand Georgia law may limit the extent to which a parent can waive a minor's own future claims, particularly for activities involving physical risk to young children, and that this applies separately to each participant listed above. This Agreement is intended to be enforceable to the maximum extent Georgia law permits. Regardless of enforceability as to any participant's independent claims, I expressly release my own claims (including medical expenses, loss of services, or loss of consortium) to the extent based on ordinary negligence of any Released Party. 5. ILLNESS, EMERGENCY CARE, AND HEALTH I assume the risk of communicable-illness exposure at a group event and agree not to bring any participant if they show fever, vomiting, diarrhea, persistent cough, contagious rash, or other illness symptoms. I authorize Event personnel (whether from Bzzzy Boys Book Club, Action Creative Village, or PEW LLC) to contact emergency services and/or obtain emergency medical care for any participant if reasonably necessary, and understand personnel are not medical professionals and have no duty beyond reasonable emergency response. I am solely responsible for all resulting medical, transportation, and related costs for each participant. 6. SUPERVISION AND PROPERTY I understand Bzzzy Boys Book Club, as the host and organizer of the Event, is responsible for providing reasonable general supervision during scheduled activities, but the Event does not provide continuous one-on-one supervision unless agreed in writing.
