Enjoy More. *************************************************************************************************************************************************************************************************************************************************************************************************************** EVENT TRANSPORTATION SERVICE AGREEMENT This Event Transportation Service Agreement (“Agreement”) establishes the terms and conditions applicable to the purchase and use of transportation services provided by Phoenix Bus Inc. (“Phoenix Bus,” “Company,” “we,” “us,” or “our”), located at 3220 37th Street, Orlando, FL 32839. By purchasing a transportation ticket, making a reservation, accepting these terms during checkout, signing this Agreement electronically or physically, boarding a Phoenix Bus Inc. vehicle, or otherwise participating in the transportation service, the purchaser and passenger (“Passenger” or “Guest”) acknowledges and agrees to the terms below. 1. NATURE OF SERVICES Phoenix Bus Inc. provides passenger transportation services in connection with concerts, sporting events, festivals, entertainment events, corporate events, special events, and other group transportation activities. Services may include: • Round-trip event transportation • One-way transportation • Shuttle transportation • Group transportation • Charter transportation • Dedicated event transportation • Transportation between designated pickup locations and event venues • Transportation between Orlando and other Florida destinations • Transportation coordination and event logistics Unless expressly stated otherwise, Phoenix Bus Inc. transportation is limited to the transportation service described in the applicable reservation, ticket, confirmation, or promotional materials. A transportation reservation does not constitute a ticket or guarantee of admission to the event or venue unless expressly stated otherwise. 2. EVENT TICKETS ARE SEPARATE Unless specifically included in the purchase, Phoenix Bus Inc. does not sell, provide, guarantee, or control admission tickets to the event or venue. The Passenger is solely responsible for obtaining a valid event ticket and complying with all event and venue requirements. Phoenix Bus Inc. is not responsible for a Passenger's inability to enter an event because of: • Failure to purchase an event ticket • Invalid or counterfeit tickets • Incorrect identification • Age restrictions • Venue policies • Security requirements • Prohibited items • Dress codes • Late arrival • Removal from the venue • Any other venue or event admission requirement A Phoenix Bus Inc. transportation reservation remains separate from the event admission process. 3. TRANSPORTATION SERVICES Phoenix Bus Inc. may provide transportation using motor coaches, charter buses, shuttle buses, vans, school buses, or other appropriate passenger vehicles based on the requirements of the event. Phoenix Bus Inc. will make reasonable efforts to provide the vehicle type, capacity, amenities, and service described in the applicable reservation or promotional materials. However, no specific vehicle is guaranteed unless expressly confirmed in writing by Phoenix Bus Inc.. Phoenix Bus may substitute a vehicle when reasonably necessary because of operational, maintenance, safety, availability, or scheduling considerations. Any replacement vehicle will be reasonably suitable for the transportation service whenever practicable. 4. PASSENGER RESPONSIBILITIES Passengers are responsible for: • Arriving at the designated pickup location on time; • Having the required reservation or ticket information; • Following driver and Company instructions; • Remaining seated when appropriate; • Using available seat belts where required or provided; • Boarding and exiting the vehicle safely; • Maintaining appropriate conduct; • Respecting other passengers; • Protecting their personal belongings; • Complying with applicable laws and transportation rules; Passengers must not interfere with the driver or otherwise create a safety risk. 5. PICKUP AND DEPARTURE TIMES Passengers must arrive at the designated pickup location before the published departure time. Phoenix Bus Inc. may depart at the scheduled time regardless of whether an individual Passenger has arrived. The scheduled departure time is not the time at which passengers should arrive. Passengers should allow sufficient time for parking, traffic, walking to the pickup location, checking in, and boarding. A Passenger who misses the scheduled departure is responsible for arranging and paying for any alternative transportation. Phoenix Bus Inc. is not required to delay the vehicle for passengers who arrive after the scheduled departure time. 6. RETURN TRANSPORTATION For round-trip event transportation, Phoenix Bus Inc. will establish a designated return departure time and/or meeting location. Passengers are responsible for being at the designated return location before the scheduled departure time. Phoenix Bus Inc. may depart at the scheduled return time even if a Passenger has not arrived. Passengers who voluntarily remain at the event after the scheduled return departure are responsible for arranging and paying for their own transportation back. Phoenix Bus Inc. does not guarantee that a Passenger who misses the scheduled return departure will receive alternative transportation. 7. TRANSPORTATION RISKS Passenger understands that transportation by motor vehicle involves inherent risks that cannot be completely eliminated. Such risks may include: • Traffic accidents; • Sudden braking; • Sudden acceleration; • Sharp turns; • Traffic congestion; • Road conditions; • Weather conditions; • Mechanical problems; • Vehicle malfunction; • Actions of other motorists; • Delays; • Road closures; • Construction; • Police activity; • Boarding and exiting the vehicle; • Slips, trips, and falls; • Movement inside the vehicle; • Personal injury; • Property damage; • Changes to pickup or drop-off locations. Passengers voluntarily participate in the transportation service with knowledge that these ordinary transportation risks exist. 8.
