Access to justice remains a cornerstone of the Australian legal system, however it is not uncommon for individuals to appear in a Tribunal or Court without legal representation and the numbers are growing. Self-represented parties pose significant challenges for decision-makers as they are unfamiliar with legal procedure, evidentiary rules and substantive law. Decision-makers need to ensure that obligations and expectations are communicated to parties appearing in person from the beginning to ensure cases are managed efficiently and respectful conduct is maintained.
